What is an Independent Children’s Lawyer?

How is an ICL appointed?

The appointment of an ICL is usually made by the court in cases where there are significant concerns about the child’s welfare. This can include situations involving:

  • Complex issues regarding the child’s health, education, or cultural needs.
  • Cases where the child’s wishes need to be ascertained and presented to the court.

In Australia, an ICL is typically appointed from a panel of experienced family lawyers maintained by Legal Aid commissions in each state and territory. Who pays for an ICL?
